Flood Insurance Program Extended for Five Years - Matawan ...

President Obama signed into law on June 30?the Flood Insurance Reform and Modernization Act of 2012. Many of us in the insurance industry had been lobbying Washington DC to give us the much-needed reforms and permanency for our flood insurance markets.

Since 2008, the US Congress has let the National Flood Insurance Program (NFIP) expire 17 times and some of those expirations have impaired a wide variety of real estate transactions. With the passage of this new reform law the NFIP will remain in place for five years without any interruption.

There will be several changes to the flood insurance program; mostly provisions that will make the flood insurance program self-sustaining without the need for an infusion of money to keep the program afloat. Certain properties that are too close to tidal waters will see a phase-out of subsidies. The flood insurance program in the past had maximum annual increases of 10% these will now be increased to 20%.

Other noteworthy provisions of the new law:

  • Requires the NFIP Administrator to develop a plan for repaying the debt incurred from Hurricane Katrina
  • Mandates that rates for secondary homes, properties with repetitive flood claims and commercial properties will go up 20% over the next five years.
  • Policyholders will be allowed to pay in installments instead of one lump sum.

Many of the details of the law will be subject to regulatory interpretation and implementation over the next 2 to 3 years in a serious effort to make the federal program self-sustaining.

What we as consumers can look forward to is a federal program that will have insurance rates much higher than what we have seen in the past and a larger emphasis on encouraging greater private sector participation in providing flood insurance coverage.

Notes from Dallas Cowboys training camp in California

OXNARD, Calif. (AP) - Here are some notes from Dallas Cowboys training camp in California:

The team's first full-squad workout is set for Monday.

The Cowboys and Oakland, who play each other in an exhibition game Aug. 13, were the last two NFL teams to report to training camp.

The Giants, where the Cowboys play the NFL's season opener Sept. 5, reported to camp Thursday.

Cowboys coach Jason Garrett said there will be "plenty of time" to get his team ready to play.

Garrett says cornerback Mike Jenkins, who is still recovering from offseason shoulder surgery, is getting better and making progress. The coach is hopeful that Jenkins, the disgruntled former Pro Bowler who asked for a trade, can hopefully get on the field in the "next week or two" and play in an exhibition game or two during the preseason.

Cholesterol RatioIn the past, doctors have focused on the ratio of our good cholesterol (HDL) to our total cholesterol but, in today?s medical community, there is growing consensus that a closer look at bad cholesterol (LDL) is our best management tool.

Total Cholesterol contains good cholesterol that protects our heart, known as High Density Lipoprotein (HDL) and bad cholesterol that is harmful to the heart, known as Low-Density Lipoprotein (LDL).

Cholesterol, although a fat, is an essential nutrient for the body. It is made in the liver. The liver produces cholesterol in the necessary quantities for a healthy body, then revs up its production when we ingest a diet high in saturated fats and foods such as meats, dairy products and eggs. When the liver cannot efficiently dispose of the cholesterol excesses of a high fat diet, the excess cholesterol becomes bad cholesterol (LDL) and travels to the arteries of the heart and deposits itself there in the form of plaque. As the plaque accumulates, the walls of the arteries narrow and blood flow to the heart is restricted and eventually blocked.

The theory that ?a higher ratio of something good to something bad is always better? is especially true for a healthy heart. This new standard compares our bad cholesterol (LDL) to our good cholesterol (HDL), rather than our good cholesterol to our total cholesterol.

Here are two examples, both using the same method, of how to arrive at the ratio of your bad cholesterol (LDL) to your good cholesterol (HDL):

*LDL of 129 divided by HDL of 40 = a ratio of 3.2

*LDL of 99 divided by HDL of 60 = a ratio of 1.7

The first ratio example of 3.2 indicates the lesser risk of having a heart attack or stroke as compared to the higher risks of up to 11.0. The lower the ratio the better. In general, a ratio of 3.5 or below is recommended.

The second ratio of 1.7 represents the recommended guidelines for optimal, or the best, levels of good and bad cholesterol, which is below 100 for LDL and above 59 for HDL. A ratio of 1.7 or any ratio below 3.3 is considered even better than a low risk.

Risk Levels for Heart Attach or Stroke due to blocked arteries:

* Considered a Low Risk: 3.3 to 4.4

* Considered an Average Risk: 4.4 to 7.1

* Considered a Moderate Risk: 7.1 to 11.0

* Considered a High Risk: 11.0

Consider these three questions:

* Is your blood pressure above healthy levels?

* Do you smoke cigarettes?

* Do you have a family history of heart disease?

If your answer is ?yes? to any of the above, you may have additional risk factors for heart disease, even if your cholesterol risk-ratio is at optimal levels. While you can do nothing about family history, general medical advice urges us to get control of high blood pressure and quit smoking.

If you do not know your cholesterol numbers: total cholesterol, HDL and LDL, make an appointment to discuss your cholesterol ratios with your doctor and request a copy of your lab report for your files. Your physician?s analysis is your best guide to cholesterol management.

Ian Thomsen: Kirilenko getting taste of NBA season as Russian leader in London

LONDON -- No one with a non-Russian accent could have been cheering more loudly for Andrei Kirilenko than David Kahn, the GM of the Minnesota Timberwolves who recently signed the Russian forward to a two-year, $20 million contract. Kirilenko opened the Olympic basketball tournament Sunday with 35 points to lead Russia to a 95-75 win over Great Britain.

The 31-year-old Kirilenko had developed a history of injuries during his 10-year NBA career with the Utah Jazz, but now he looked renewed. "I feel great,'' he said. "I'm running like a young deer.''

Not only did he convert 14 of 17 field goals while pushing the pace, he also blocked three shots like the explosively young Kirilenko who earned a place in the 2004 All-Star Game while making three straight All-Defensive teams. He believes his year with CSKA Moscow renewed him physically. "I would say so,'' said 6-9 Kirilenko. "We had a pretty good schedule -- we only play twice a week. But I feel I'm ready to play because we had a lot of practices.'' Though he also admitted with a laugh, "I would rather play games than practices.''

The onset of the lockout convinced Kirilenko to move back to CSKA, which was his original club before he joined the Jazz in 2001, two years after they had chosen him with the No. 24 pick in the draft. "I would say because of the lockout I had a unique chance to stay in Moscow, to kind of give back -- play for my friends, play for my family,'' Kirilenko said. "When the lockout was over, I knew the season was going to be a disaster. And everybody said it's a disaster -- a lot of injuries.''

He was referring to the truncated schedule that limited training camp and days of rest amid the 66-game season. His wariness of those consequences helped convince him to spend the remainder of last season in Russia.

"I said, OK, I have a great time right now,'' he said. "I'm going to finish the season (with CSKA) and then I'm going to make my decision to either get back or play in Moscow.''

The opportunity to return to the world's best league drove Kirilenko to the Timberwolves, in the much the same way as it inspired his current and future teammate, Alexey Shved, the 6-6 guard who this summer signed a three-year, $10 million deal with Minnesota. Russia overcame an impassioned 26-point effort by GB's Luol Deng thanks to the partnership of Kirilenko and Shved (16 points and 13 assists), who showed outstanding comeraderie on the floor after teaming together for CSKA last season. Kirilenko promised more of that for partnership for the Wolves. "I said, 'That's how you're going to find me (in Minnesota),'' Kirilenko said. "We got a connection.''

The Russians have size, length and athleticism across the board, as well as the continuity of years together under American coach David Blatt. They'll be contending for a medal here, but the future employer of Kirilenko and Shved will be thinking ahead to next November.

"If I'm the Minnesota Timberwolves,'' said Blatt, "I've got a big fat smile on my face.''

Not everyone was smiling. Ettore Messina, who has been hired to coach CSKA next season, passed through the mixed zone and stopped in front of Kirilenko. "Kirilenko! Kirilenko!'' shouted Messina, who was a consultant for the Lakers last season. When Kirilenko looked up, Messina pointed at him with a big grin and cursed him enthusastically as they both laughed.

"I know Ettore from a long, long time ago,'' said Kirilenko later. "I know he's a great coach, a great guy. But he understands my position right now. I have to get back and play at the highest level.''

Cheating Or Not: What Does "Being Faithful" Actually Mean?

How Do You Define Cheating?How come this topic hasn?t been discussed more frequently? I mean, there?s zero doubt that infidelity is a factor in countless broken relationships.

Perhaps we encounter so little elaboration on the subject because each of us believes we have a firm grasp of what it means to be ?faithful? to a significant other.

But do we really? And what?s more, does our PARTNER believe the same way WE do? You just can?t make that assumption by default, or else serious trouble will be looming sooner than later.

Clearly, the key is open, honest communication early on.

So why do so many couples leave this topic ?open ended?? The problem arises when neither partner wants to come off as overly jealous or insecure, or when one partner fears that opening such a ?can of worms? will actually trigger jealousy in the other.

Nevertheless, if you care about a relationship, both of you have got to set expectations for yourself and for each other, and agree to them together.

Here are four particular areas that can help focus the somewhat nebulous topic of ?fidelity?, making it easier to talk about and simpler to define.

?
1. Decide What The Structure Of The Relationship Is

I was asked a fascinating question recently during a radio interview. ?So Scot, if you want your wife to agree to a threesome and you think she?s going to object, how do you convince her to agree to it??

My answer caught the host completely off guard. ?You don?t?, I said. ?If you are open to threesomes and you know she isn?t, you shouldn?t have married her to begin with. These are things you bring up with your new girlfriend, not someone you?re already in a committed relationship with.?

The very foundation to trust and fidelity is defining whether you are in an exclusive and monogamous relationship with someone as opposed to some other kind of relationship.

?Other? in this case can mean you?ve agreed to bring other partners into your sex life together, agree that both partners can have sex with other people, or some mixture of both. No matter what, however, you?ve got to carefully define what?s fair game and what isn?t well ahead of time?before any assumptions are made, and most definitely before you walk down the aisle.

?
2. Set Flirtation Boundaries

Another area discussion involves how ?flirtation? with other MOTOS (members of the opposite sex) is defined. It?s mission-critical that the two of you agree 100% on what those boundaries are and that they are the same for both partners.

For example, if it?s decided that sexually charged conversation and body language along with playful touch are to be kept within the relationship, then so be it.

There can be no ?double-standard?, however. For example, a woman cannot be of the opinion that all women are generally well-intentioned, but all men are dogs if given the chance.

That train of thought is not only arrogant, it creates an environment where she defends her little wink at the waiter as she touches him on the thigh as ?harmless? even as she objects to her boyfriend or husband even smiling at a waitress.

Where the ?double standard? is in effect, deep resentment surely follows.

?
3. Define Out-Of-Bounds Activity

I find it particularly amazing how many unspoken assumptions are made between men and women in this specific area.

But the truth remains that when it comes to the subject at hand, this is one of the broadest expanses of ?gray area?.

The range of factors at play here is almost mind numbing.

I?ve known at least one couple where one partner felt that kissing other people was NOT cheating, but had somehow let that aspect of their belief system escape coming up in conversation together.

Suffice it to say that the other partner had felt it was implicitly obvious that the two of them shouldn?t be making out with other people if they?re in an ?exclusive? relationship.

But don?t kid yourself. In other cases, the fine line may be much more difficult to draw.

For example, you and your partner may readily agree not to tongue down other people, but what about full-body embraces?

And how about having social contact with exes (or other MOTOS, for that matter)? Is it okay to talk to them on the phone or even have lunch with them sometimes because they?re now ?just friends??

If that?s off the table, is it alright to at least friend them on Facebook? Do you keep their numbers stored in your phone, if for no other reason than so if they call you can know not to answer the phone?

And what about, say, porn? Does looking at other MOTOS naked constitute cheating? How about frequenting strip clubs? No doubt there are a LOT of women out there who don?t view this stuff the same way that a LOT of men do.

You?ve got to talk about all of this, and you?ve got to cover all bases (including first).

?
4. Just Say ?No? To Logical Justification

I?ve always found the whole concept of ?bachelor parties? deeply fascinating. Stereotypically speaking, the infamous sexual trysts that might possibly happen once strippers, etc. get involved are accepted as kind of a ?last hurrah? before the ?constraints? of marital life kick in.

Obviously, most people don?t tell their new wife (or husband, in the case of certain ?bachelorette parties?) what actually happened the night before. The best-case scenario one can hope for is a ?don?t ask, don?t tell policy?.

But the way I see it, if you feel like you?ve got to get one last ?piece? in because you feel as if you?re about to get locked down with a ball and chain, you most definitely shouldn?t be getting married to begin with.

Nevertheless, many people justify bachelor and bachelorette parties as a ?rite of passage?.

This is one clear way that we tend to seek logical justification for behavior that to most observers would constitute cheating. And in fact, we?re talking about actions that even WE would consider unfaithful?if under different circumstances.

I?ve noticed that a surprising number of people?men and women alike?somewhat nihilistically think that all MOTOS will happily cheat, if presented with a tempting opportunity.

Meanwhile, many people of both genders have honorable intentions from the very beginning of always being faithful.

What?s weird is that when one partner is unreasonably jealous to the point of fearing that the other will cheat?or that he or she is already doing so?that fear can eventually become a self-fulfilling prophecy.

The faithful partner who is consistently suspected or even flatly accused of cheating finally says to him or herself, ?If I?m going to get treated like I?m a cheater, I might as well make something happen to justify it.?

A similar thought pattern would be, ?If I?m going to be considered a cheater, I might as well get the ?benefits? as well as the penalties.?

The potential danger of extreme jealousy to fidelity in relationships goes even deeper.

When one partner is super jealous, it becomes LESS likely that boundaries will even be discussed. The less jealous partner assumes that ANY discussion on the subject wouldn?t end well.

So each partner is left to decide what constitutes ?cheating? him or herself.

That means that when one?s significant other is the ?ber-jealous type, that less jealous partner?s decisions are indeed made without the other?s input because it?s assumed that EVERYTHING would incite his or her anger anyway.

From there, the proverbial envelope tends to get pushed to the limit because there ARE no established guidelines.

Perhaps subconsciously, some people will go a bit overboard to ?stick it? to a partner whose jealousy they?ve come to resent. Usually, this is taken to the extent that they feel they can reasonably defend if ever caught red-handed.

For example, this can down to semantics. A famous example would be invoking Bill Clinton?s definition of ?sex? versus what Hillary may have thought it meant

As per a memorable example from my coaching experience, one partner may suggest it?s time to ?date other people? but the decision is ultimately made not to. Then, the partner who suggested the idea ends up having sex with someone else, but attempts to logically justify it because he or she never actually ?went on a date? with that other person.

Since the discussion was about ?dating other people? rather than ?being exclusive?, the justification for sex outside the relationship is made.

Ultimately, if you?re in a truly monogamous, exclusive relationship with someone the guidelines have got to be discussed, and no emotional mindset can ever be allowed to blur the lines. It?s really as simple as that?otherwise, there?s cheatin? going on.

Homeschooling has Many Advantages for the Education of Children ...

The most obvious is that you, the parents, to tailor education specifically targeted at special needs of your child makes. Also allows you to teach in a style that fits your child ? as we all know, different people learn better in different ways. When you decide to homeschool is important to remember that and be a parent, you are now taking over the role of the teacher. This is of course no responsibility to be taken lightly, and you should make every effort to provide the best teacher you can be.

Everyone has the experience of having good and bad teachers. If you stop and think about it, I think you see some things that you are good teachers who have in common. The important thing is that they are really interested in their field. Nothing makes a better teacher than the enthusiasm for the subject. I think you?ll also notice that most of you have a bad teacher is not interested in the subject they teach. It is for this reason it is important that the experience of homeschooling that interest you and your child.

While your child?s education should come first when creating curriculum homeschooling, you will not be ashamed to think about your own education as well. When we look at things to learn in specific subject areas, think about the things you?re interested in activities that you could not so much to discover as you like when you were at school.

It can not be underestimated how valuable experience is to learn with your child. You will strengthen family bonds, and mutual interest and excitement in the subject make sure your child to retain the information. One way to do this is to understand the balance between rigidity and flexibility in homeschooling curriculum.

A certain amount is needed in the general curriculum formalness: You have a purpose and a plan in which certain things must be learned. But their schedule, you have a high degree of flexibility, and you must use it to your advantage. When studying literature, for example, understand that the goal is to read good literature and learning, not necessarily to a particular book. So instead of studying the ?standard? new you have read, consider a new book for you. With both you and your child are interested in the book, the experience of reading together are fun for both of you because you are both satisfied with the outcome.

This concept does not apply only to the literature, think of things in science or music, for example that you always wanted to know about. If you are sure that you are interested in the subject well, your child will feel your enthusiasm and interest in the topic, provide a more valuable educational experience.

Motorola launches Motoluxe XT685 for China, and it runs Android 4.0

When we reviewed the European Motorola Motoluxe, there was one thing that let it down drastically. The software. Motorola's build quality was there in bundles, and despite being a low-powered, budget device, there was a lot to like. But it arrived with Gingerbread, and it didn't do particularly well with it either. 

Now, Motorola is set to launch the Motoluxe in China, and the XT685 as it is known comes much improved from the European one. The processor has been bumped up to 1GHz, but more importantly, the software has been bumped up to Ice Cream Sandwich. Otherwise, it looks very much the same as the European version with the same size 4-inch display, the 8MP camera on the rear and the darn sexy notification light strip in the bottom left. 

The Motoluxe XT685 is available across China now, in Brown or White, for RMB 1,999 ($313/£199) which puts in pretty much on par with its European cousin. No word yet on whether or not this will make it to any other global markets, but it looks like the device the Motoluxe should have been when it first launched.

Fears grow over fate of Syrian city of Aleppo

(AP) ? International concern was mounting Friday over a potential massacre as Syrian troops bombarded the besieged city of Aleppo with artillery, strafed it with aircraft and reportedly pulled in major reinforcements ready to crush the outgunned rebels.

The battle is one of the most important of the 17-month-old uprising. With a population of about 3 million, Aleppo is Syria's largest city and commercial hub, a key pillar of support for President Bashar Assad's regime.

The rebels controlled several neighborhoods but were facing reports of troops and tanks massing outside the city. The nonstop fighting in Aleppo already has claimed the lives of at least 145 rebels and civilians in the last six days, according to the Britain-based Syrian Observatory for Human Rights.

U.N. High Commissioner for Human Rights Navi Pillay expressed "deep alarm," saying in a statement that the "reported build-up of forces in and around Aleppo, bodes ill for the people of that city ... it goes without saying, that the increasing use of heavy weapons, tanks, attack helicopters and ? reportedly ? even jet fighters in urban areas has already caused many civilian casualties."

In at least two formerly rebel-held Syrian areas over the summer, Qubair and Houla, hundreds of civilians were killed after pro-regime militias moved in, according to activists.

It has been a difficult two weeks for the Syrian government with rebel assaults first on the capital, Damascus, and then on Aleppo, as well as several high-profile defections and a bomb that killed four top security officials.

The government, however, struck back and quashed the assault on the capital with a combination of heavy weapons and house-to-house searches. Scores of people were killed. Opposition activists said they expected similar tactics in the coming days to keep Aleppo from falling into rebel hands.

"I think there will be a huge massacre in Aleppo," said Michel Kilo, a veteran opposition figure living in exile in Paris. "There will be a terrible revenge against civil society." He said all of Aleppo, once believed to be a regime stronghold, was revolting against Assad's regime.

His concerns were echoed by British Foreign Secretary William Hague and U.N. Secretary General Ban Ki-Moon, both of whom called on Assad to immediately halt the attack on Aleppo.

"I am deeply concerned by reports that the Syrian government is amassing its troops and tanks around Aleppo, and has already begun a vicious assault on the city and its civilians," Hague said, speaking at the opening of the Olympics in London. "This dire situation illustrates very strongly why the people of Syria needed the U.N. Security Council resolution we proposed last week."

Speaking at the same event, Ban added that "the violence from both sides must stop for the sake of the suffering civilians of Syria."

Western nations in the U.N. Security Council have been trying to pass a strong resolution condemning Syria and imposing harsher international sanctions. Russia and China have blocked them, citing concerns that such measures could pave the way for foreign military intervention ? as was the case in Libya.

The threat that Moammar Gadhafi's forces could retake the Libyan rebel stronghold of Benghazi in March 2011 resulted in a U.N.-mandated no-fly zone that opened the way for a vigorous NATO bombing campaign. Russia maintains that NATO overstepped its bounds and does not want that to happen in Syria too.

As a result, there is little the international community can do to help the rebels surrounded in Aleppo ? or in other Syrian cities like Hama, Homs, Deir al-Zour and Daraa, where bombardments and casualties are reported daily. Activists estimate more than 150 people are killed every day nationwide. July is set to become the bloodiest month of an uprising that activists say has claimed 19,000 lives since it began on March 2011.

Gulf countries like Saudi Arabia and Qatar are believed to be funding the rebels through Turkey and there have been indications that the ragtag rebel group called the Free Syrian Army is using better weapons and tactics, as seen by their tenacious hold on neighborhoods in Aleppo and other cities.

The former head of the U.N. observer mission said Friday that he expected the Assad regime to fall eventually, but that the aftermath could witness even more bloodshed.

"It's impossible to imagine a future in Syria where the current people in power remain in power. So in that view, it's just a matter of time before this regime collapses," Maj. Gen. Robert Mood said at a news conference in Oslo, Norway.

Mood, who left Damascus on July 19, warned that the regime still has a great deal of military muscle. The core of the army, which has vast reservoirs of weaponry, has remained loyal to Assad.

But the regime has been embarrassed by several high-ranking defections including three diplomats. On Friday, Ikhlas Bawadi became the first member of Syria's new parliament elected in May to defect.

"The violence being perpetrated by Bashar Assad's regime against innocent people who are seeking freedom is unacceptable," she told the Turkish Anadolu agency. "I could no longer tolerate the oppression, that's why I left. I will keep working to free all my friends from the oppression."

In Damascus, meanwhile, the International Committee of the Red Cross said it was temporarily moving some of its foreign staff to neighboring Lebanon. A Red Cross spokesman in Geneva, Hicham Hassan, said the move was prompted by security concerns but that a core team of about 50 staff would remain.

Hassan also told The Associated Press that the Syrian Arab Red Crescent was suspending some of its operations in the capital because of "the deteriorating security situation."

"This in no way means we are suspending our activities, especially at a time when needs are growing. ... They will go back to Damascus at the appropriate time."

Poland, meanwhile, announced that it had closed its embassy and evacuated its diplomats from Damascus. The Polish embassy had been representing U.S. interests in the Syria since the U.S. closed its own in February.

NATO route suspended over security | Pakistan Today | Latest news ...

PESHAWAR?-?Pakistan has temporarily stopped NATO supply trucks crossing into Afghanistan over security concerns due to fears of attacks, officials said Thursday.

Gunmen on Tuesday attacked a convoy of NATO supply trucks, killing a driver, in the town of Jamrud on the outskirts Peshawar.

"Movement of NATO vehicles has been temporarily suspended since Wednesday evening to beef up security," a paramilitary official told AFP.

"We have launched a search operation in the hills surrounding Jamrud," the official added.

Local administration official Bakhtiar Khan confirmed the supply route had been suspended due to "security reasons".

"Intelligence officials have informed the authority that attacks may occur on NATO vehicles this week and in the light of this a security plan is being chalked out," Khan told AFP.

He said the NATO route would "resume very soon", but that until then trucks carrying supplies for the 130,000-strong US-led mission in Afghanistan had been told not to approach the border.

Changing Your State's Recreational Use Statute To Include Private ...

Minnesota joins 15 other states in providing protection for private airstrip owners who allow other pilots to use their airstrips. Within the region served by Midwest Flyer Magazine, only South Dakota and Minnesota, and parts of Nebraska, have made the change. I would like to invite pilots from all Midwest states to likewise make the effort.

Each of the 50 states has a Recreational Use Statute (RUS). (See the sidebar from the Recreational Aviation Foundation for a full explanation.) The RUS is sometimes called the ?Good Guy Law? ? it could be summed up by saying that a landowner has no liability if he allows someone to use his land without charge, and doesn?t overtly create a hazard. These two limitations are important.

Most Recreational Use Statutes were created to encourage landowners to allow people to use their land?there is not enough public land to accommodate all who would like to use it. Recreational uses usually say ?includes, but are not limited to the following activities?..? The statute then goes on to list types of activities. In Minnesota, RUS lists ?hunting; trapping; fishing; swimming; boating; camping; picnicking; hiking; rock climbing; cave exploring; bicycling; horseback riding; firewood gathering; pleasure driving, including snowmobiling and the operation of any motorized vehicle or conveyance upon a road or upon or across land in any manner, including recreational trail use, nature study, water skiing, winter sports, and viewing or enjoying historical, archaeological, scenic, or scientific sites??? That?s quite a lot of activities, but it DOESN?T say anything specifically about aviation. That is what we set out to change.

The Problem

Aircraft owners, pilots, and airstrip owners are gregarious sorts. The private airstrips might be Flying Farmer strips, residential airparks, Light Sport Aircraft strips, glider ports, private seaplane bases, or private heliports, or simply a private airport. Most of these airstrip owners would love to have people drop in (with permission, of course), but have been leery of the possibility of encountering a lawsuit if something went wrong. For that reason, many airstrip owners have de-listed their strips from the aeronautical charts (and GPS databases), even though they were listed as ?restricted? or ?private.? The actual number of prosecutions of private airstrip owners has been few, but in today?s society, nobody wants to incur the legal expenses to defend themselves from simply being a ?good guy? and allowing someone to use their airstrip. How many times have you been flying along, looking down, and discovered an unlisted private strip? Now you know why.

The Solution ??The Recreational Aviation Foundation

We need to give airstrip owners the same protections afforded other recreational activities. Why should aviation be any different than the other activities? I contacted the Recreational Aviation Association (RAF). RAF is a charitable, non-profit organization dedicated to the preservation and promotion of private airstrips. According to their website, the purpose of the organization is to:

? Acquire private land for the development of new airstrips,

? Assist in funding the building of new airstrips on public land,

? Develop educational materials to assist pilots in being knowledgeable advocates,

? Fund efforts to gain national recognition of backcountry recreational aviation and airstrips as a legitimate use of public lands.

? Provide educational information regarding recreational airstrips to members of Congress and their staff.

I contacted the RAF and within hours, I had a returned phone call from John McKenna, President of the RAF. I was impressed?RAF is that kind of organization ? straight talk, all action ? as exemplified by the rapid return on a phone call. McKenna outlined the background and mission of the organization: preservation and expansion of private and remote airstrips. The organization started in Montana, and made its mark in preserving remote airstrips in the American West. The concept caught on, and RAF has experienced explosive growth across the country. The organization has been SO successful that RAF received recognition as one of the five ?Best Products of the Year? from Flying magazine. Even though it is not really a ?product,? but an organization, Flying was so impressed with their mission and accomplishments that the magazine gave them the award. Similarly, RAF won the Lightspeed ?Pilot?s Choice Award? as the choice of most pilots as the aviation organization most deserving of the Lightspeed $10,000 grant. Today, RAF has members in all 50 states. Even more important, RAF has a ?seat at the table,? along with other aviation organizations when discussing national aviation policy.

McKenna advised me that the key to affording protection for private strip owners was to make a simple change in the State Recreational Use Statute, and that though RAF would help, this must be a local effort!

We contacted Sen. John Carlson from Bemidji, Minnesota. To introduce a companion bill in the House, we contacted Rep. David Hancock, also from Bemidji. Bemidji is in the northern part of the state, and there are a number of private and resort airstrips there. Even more important than their geographical location, though, were the legislators themselves. I have a friend that is a former legislator himself, and asked his advice on who should carry the bill. These individuals were his recommendations.

Lesson Learned #1: Find the very best legislator to carry the bill. Their heart has to be in it, and they must be tenacious to carry on when the inevitable legislative snags occur. Many bills are introduced into the legislature every year; only a small percentage actually survive. Having these two legislators carry the bill was one of the best things we could have done. When problems arose (as they inevitably do), these experienced legislators enlisted the assistance of Rep. McNamara (Chair of the Natural Resource Committee), and Rep. Beard (where it was attached in the House). Bills often take strange turns on the way to passage, and an experienced legislator that really believes in a bill makes all the difference in the world.

Lesson Learned #2: Introduce bills in both houses. The probability of passage increases greatly. If one bill runs into difficulty, the other proceeds. If there is a difference in the bills, it can be worked out in a conference committee.

Lesson Learned #3: Provide multiple copies of your position to your legislators. In the Minnesota case, I provided RUS information from the RAF, with their permission. I provided text from states that had recently amended their RUS documents to use as an example. I provided examples of those who would benefit from the change STATEWIDE, not just from their districts. Examples included Flying Farmers, airpark communities, resorts, seaplane bases, heliports, glider ports, and aeromedical evacuations. I then provided a single-page summary legislators could use. Finally, I provided them with the RAF website, and being conscientious legislators, they did use it to verify the information I had given them.

Lesson Learned #4: Have an experienced and savvy legislator that believes in your cause. Though the bill went through the House with little opposition (Rep. Hancock actually picked up co-sponsors along the way!), it had some questions in the Senate. Sen. Carlson met with a representative of the Minnesota Association for Justice (formerly Minnesota Trial Lawyers Association) to discuss their initial concerns ? most of which centered on what the definition of ?non-commercial aviation? was. We suggested that we simply use the definition of ?commercial operation? from the Minnesota Department of Transportation, Office of Aeronautics, as what constituted a commercial operation. Afterall, if it was good enough for the regulatory agency for commercial operations, it should suffice for this bill. The Bar Association was satisfied with that.

Both Representative Hancock and Senator Carlson stayed in constant contact. Because time until adjournment was waning, Sen. Carlson attached the bill to an omnibus Game and Fish bill for a vote. He was able to do that because the RUS in Minnesota (like so many other states) originated as a Game and Fish bill when it was first introduced, making it ?germane? to a Game and Fish bill. That was a smart move on his part, and another indication of why it is so important to have an experienced legislator on your side. When time came for testimony in the House-Senate Conference Committee to reconcile differences in the House and Senate on the differing bills, I addressed the committee to answer questions. There was a call from one member to add additional clarifying language. The representative from the Bar Association actually sat down next to me and said, ?Mr. Hanson?s short definition of the bill hit it out of the park. We have reviewed the language from MN/DOT Aeronautics, and have no objections to it. We feel that no additional language is warranted.? Imagine that?because of Sen. Carlson?s foresight and planning, a potential problem was averted, and a potential adversary became an ally!

The bill cleared the conference committee, and the omnibus bill was passed by the legislature and signed into law by the governor in May 2012.

What Does This Mean For Minnesota Pilots & Airstrip Owners?

? It means that an airstrip owner may allow other pilots to use a private airstrip without fear of legal issues, subject to the limitations previously stated.

? Airstrip owners may want to list their airstrips for inclusion on aeronautical charts and databases.

? Resorts can advertise availability of their airport, bringing more business.

? Aviation-related businesses may now allow customers to use their airports and seaplane bases.

? These private airstrips are available for emergency flights (aeromedical flights, for example).

? Pilots can get more utility from their aircraft by landing closer to their destination if they secure permission to do so. This is also good for nearby communities.

? Safety is enhanced. If a pilot needs an airport in a hurry due to an emergency or bad weather, the number of options will be greatly increased.

All of This Is At No Cost To Taxpayers. That?s good legislation!

ACTION

1. If you would like to consider amending the Recreational Use Statutes in your state, look up the Recreational Aviation Foundation at www.theraf.org. They have an excellent website. If you look under ?pilot info,? you will find their contact information (you have to like an operation that lists phone numbers and email information for every person in the organization!), or simply call 406-582-1723.

2. On viewing the website, you will want to join the Recreational Aviation Foundation. RAF is a non-profit organization that is also dedicated to having flying fun!

3. Show this article to every owner of a private airstrip that you know so that they will be aware of the benefits of changing the Recreational Use Statute in their state, and their ability to allow others to use their airstrips with permission without fear of legal issues.

Recreational Use Statutes

All states in the USA have recreational use statutes that immunize landowners from liability when they allow the public to enter their land for recreational activities. Few states, however, expressly set forth airstrips and associated aircraft operations as a form of recreational activity. While the laws are similar in many respects, states differ in terms of the type of land protected, whether the land needs to be suitable for recreation, and the types of individuals and organizations that may qualify as landowners. States also vary with regard to the recreational activities covered and whether landowners need to give permission for the public to engage in those activities in order to receive protection. If landowners impose charges on the users, the laws may no longer protect the owners. Questions arise over the duty of care and whether the owner acted willfully or maliciously in endangering users. The variety of questions raised indicates that pilots and airstrip owners in the various states would benefit from a thorough review and possible revision of their recreational use statutes to ascertain if aviation activities are specifically included within the provisions of their states? recreational use statute.

What Is A Recreational Use Statute?

?Recreational Use Statute? is a term given to legislation generally intended to promote public recreational use of privately owned land. The statute does this by granting landowners some protection from liability for personal injuries or property damage suffered by land users pursuing recreational activities on the owner?s land. The underlying policy of a Recreational Use Statute is that the public?s need for recreational land has outpaced the ability of local, state, and federal governments to provide such areas and that owners of large acreages of land should be encouraged to help meet this need. Changes in lifestyle and the environment during the last few decades further support this rationale. These changes include increases in the material wealth and leisure time of urban residents enabling them to spend more time on recreation, a decline in the amount of public recreational space available to urban residents, an increased awareness of the health and fitness benefits of recreation, a desire to provide the public with opportunities to enjoy the benefits of modern environmental control, and a response to increased private tort litigation of recreational accidents.

How Does A Recreational Use Statute Work?

Generally speaking, a Recreational Use Statute (R.U.S.) provides that a landowner owes, to one using his of her property for recreational purposes and without charge, neither a duty of care to keep the property safe for entry or use, nor a duty to give any warning of a dangerous condition, use, structure, or activity on the property. Under prior common law (law made by court rulings), the landowner had different duties of care depending on whether a person was on the land as an invitee, licensee, or a trespasser. The greatest duty of care was owed to an invitee and no duty was owed to an unknown, adult trespasser. Under an RUS, recreational users are treated in the same manner as trespassers and thus the landowner owes them no duty of care. The protection of the statute is lost, however, if the landowner charges for the use of the land or if the landowner is guilty of malicious conduct.

When Is A Landowner Protected?By A Recreational Use Statute?

The principal question addressed by courts in personal injury and wrongful death litigation where a RUS is in effect, is whether the statute applied under the facts that existed at the time of injury or death. If the facts are determined to be outside of the statute, liability will be determined in accordance with principles of state common law. For instance, if the court determines that the landowner didn?t qualify as an ?owner? defined by the statute (see below), the facts would be considered to be outside of the protection of the statute. Each state?s RUS was drafted with conditions specific to that state in mind. Therefore, landowner liability can vary greatly from state to state. Furthermore, judicial interpretations of the various statutes differ greatly, such that similar statutes may yield very different results when tested in court. It is therefore very important to check your state?s RUS to see how much protection it offers and how the state court has interpreted it. A Recreational Use Statute acts as a deterrent to lawsuits?not total protection against lawsuits.

Who Qualifies As A ?Landowner??Under A Recreational Use Statute?

In order to be protected under a Recreational Use Statute, a person must qualify as an ?owner? under the statute. Most Recreational Use Statutes broadly define ?owner? to include the legal owner of the land, a tenant, lessee, occupant or person in control of the premises. Some statutes also consider the holder of an easement an ?owner.? A very important issue is whether or not a public entity or municipality qualifies as an ?owner? under the state?s Recreational Use Statute. Some statutes specifically include public entities in the definition of ?owner? (e.g. Alabama, Illinois, Ohio), while others specifically exclude them (e.g. Florida, Iowa, Minnesota). Still others are silent on the issue and have left it to the courts to decide. Thus, in the states that include public entities as ?owners? under their RUS, public land falls within the protection of the statute.

What Type of Land Falls Within?The Scope of The Statute?

Most Recreational Use Statutes apply broadly to land and water areas, as well as to buildings, structures, and machinery or equipment on the land. Again, each state will vary in how broad the statute and its interpretation will go with respect to what constitutes ?premises? covered by the statute. Some states will follow closely the intent of the statute and include only those lands amenable to recreational use (for example, under Louisiana?s RUS, the land must be an undeveloped, nonresidential rural or semi-rural land area in order to fall within the protection of the statute), while others will make a much broader interpretation and only consider whether a recreational activity had taken place on the land, regardless of how suitable that land was for recreational use (e.g. California, Connecticut).

What Activity, Use or Purpose?Qualifies As ?Recreational??

Many Recreational Use Statutes include, in the text of the statute, a definition of ?recreational use? or ?recreational purpose.? These definitions usually include a list of activities such as hiking, swimming, fishing, pleasure driving, nature study, etc. The phrase ?includes, but is not limited to? also appears in order to prevent a narrow interpretation of what constitutes a ?recreational use.? Some courts, however, limit the definition to only those activities that can be pursued outdoors (e.g. Louisiana, Washington). Presumably, mountain bicycling would be considered a ?recreational use? of land by most courts even if it is not specifically listed in the definition of ?recreational use? or ?recreational activity.? However, it would be advisable to not rely on the courts to determine if a particular recreational activity is covered under the RUS. Therefore, airstrips and their associated aviation activities should be enumerated in the statute.

Limitations of A?Recreational Use Statute

Generally, the liability protection of a recreational use statute is lost if the landowner charges for the use of the land or if the landowner is guilty of malicious conduct, like purposely placing an obstacle on the runway.

Summary

It would behoove airstrip owners and pilots to research their respective state?s RUS to determine its current efficacy in protecting the landowner, as well as determining if the RUS would include aviation-related activities.
